A federal judge in Boston died on Wednesday that the Trump administration deportations of eight men convicted of violent crimes to South Sudan “undoubtedly” violated a previous order by not giving them sufficient legal procedures, including “a useful opportunity to object to their” removal operations to another country.
However, Judge Brian Murphy, from the US District Court in Massachusetts Province, did not order the return of the plane with the deportees to the United States, as the prosecutor requested.
Instead, the judge seemed ready to take the Trump administration in his words that it would be possible for the government to conduct interviews with the detainees to determine whether they had a reasonable or reliable fear of deporting him to South Sudan.
In a series of follow -up of orders issued on Wednesday evening, Murphy has developed requirements that the government must fulfill this, saying that the government is delegated to grant migrants at least 10 days to increase concerns about the safety risks that they may bear if they are sent to a third country. If it turns out that the immigrant has a “reasonable fear”, Murphy said that the government is required to reopen their immigration procedures. If they do not prove reasonable fear, the government must provide a “meaningful opportunity, and at least 15 days” to reopen their case.
In a note that clarifies his matter, Murphy criticized the government’s clear understanding of what he means “a meaningful opportunity” when he initially issued a judicial order last month limiting the removal of migrants to the third countries.

In a court hearing earlier on Wednesday, men’s lawyers who were deported have argued that the plane should be returned to the United States and men should be granted due legal procedures that “can only take place on American soil,” said Tina Ryano, Executive Director of the National Immigration Alliance.
Under these circumstances, it will be a “legal and logistical nightmare” for the detained men to access the lawyer and obtain the information they need to provide a challenge, she said.

In his matter, Murphy put the requirements of the interviews, saying that it should be made separately, with the possibility of access to lawyers and the immediate translator, and access to the necessary technology “in proportion to the arrival they will get if they are in the seizure of the National Security Ministry within the borders of the United States.”
During the court session earlier, the judge said he wanted to conduct interviews in a “appropriate place with a suitable degree of privacy”, even if that means “renting a room at the Holiday Inn Hotel”.
Murphy also said that the immigrants and their lawyers should get at least 72 hours of notification that a reasonable interview has been set for fear.
On Tuesday, Murphy issued an order directing the government to maintain the custody of any person covered by his first order to be removed to South Sudan or any other country “to ensure the practical feasibility of returning if the court finds that this removal is illegal.”
At a press conference earlier on Tuesday, the Ministry of National Security confirmed that eight migrants were placed on a trip from Texas that headed to the war on Monday, although they warned that this would not be the final destination for immigrants.
“There is no country on the ground that wanted to accept them because their crimes are very brutal and barbaric,” McLeulin, spokesman for the Ministry of National Security, told reporters at this press conference.
Many men were then convicted of the first and second -degree murder, according to the information issued by DHS.

The officials said that the countries of origin for men refused to accept them, so the Ministry of National Security in partnership with the Ministry of Foreign Affairs found a country that would accept them through a “safe agreement for the country.”

“They are not categorically safe,” Realmuto told reporters. “They are places where our separation members are not safe, and they are not given an opportunity to consult with the lawyer and take an informed option regarding fear of deporting them to those countries.”
Lawyers also said they had concerns about the circumstances faced by immigrants, who are still detained in a runway.
“No one is able to consult with them in terms of they are at the present time, and this includes a lawyer for the only person who has already obtained advice at the time of his removal.”
